Terms of Service

1. Who we are

NestPack (“we,” “us,” or “our”) is an online marketplace that connects landlords offering furnished mid-term rentals with tenants who have pets. We operate the website at nestpack.vercel.app and any associated services (collectively, the “Platform”).

2. Acceptance of terms

By creating an account or using the Platform, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Platform. We may update these terms from time to time; continued use after changes are posted constitutes your acceptance.

3. User accounts

You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to provide accurate information and to update it if it changes.

4. Landlord subscriptions and billing

Landlords who publish listings on the Platform are subject to the following billing terms:

  • Free trial. Founding landlords receive a 6-month free trial beginning on the date they save a valid payment method. No charge is made during the trial period.
  • Subscription fee. After the trial ends, the Platform charges $39/month per landlord account. Billing recurs monthly until cancelled.
  • Payment processing. Payments are processed by Stripe. By adding a payment method you authorize us to charge the card on file at the end of your trial and each month thereafter.
  • Cancellation. You may cancel your subscription at any time from your account settings. Access continues through the end of the current billing period. We do not offer pro-rated refunds for partial months.
  • Failed payments. If a payment fails, we will retry and notify you by email. Listings may be suspended if payment is not received within 7 days of a failed attempt.

The Platform does not process rent payments between landlords and tenants. Any rental payment arrangements are made directly between the parties.

5. Landlord responsibilities

Landlords agree to:

  • Post accurate, complete, and lawful listing information.
  • Comply with all applicable federal, state, and local fair housing laws, including the Fair Housing Act. This includes not discriminating against applicants with assistance animals, which are not subject to ordinary pet restrictions under the FHA and HUD guidelines.
  • Not charge pet fees or deposits for verified assistance animals (service animals and emotional support animals with documentation).
  • Respond to inquiries in good faith and honor accepted agreements.

6. Tenant responsibilities

Tenants agree to provide accurate information about themselves and their pets when submitting inquiries, to communicate honestly with landlords, and to honor agreed-upon move-in and move-out dates.

7. Prohibited conduct

You may not use the Platform to post fraudulent or misleading listings, harass other users, scrape or copy Platform content, circumvent any security feature, or violate any applicable law.

8. Disclaimers

NestPack is a marketplace platform. We do not own, manage, or inspect any listed property. We make no representations about the accuracy of listings, the conduct of landlords or tenants, or the suitability of any rental for your needs. The Platform is provided “as is” without warranty of any kind.

9. Limitation of liability

To the maximum extent permitted by law, NestPack shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including disputes between landlords and tenants. Our total liability to you for any claim shall not exceed the amounts you paid us in the 12 months preceding the claim.

10. Governing law

These terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in California.
